Preamble

  • Tunetoo is a brand operated by BDL (Broderie de Lomagne) under a licence agreement with Mr. Paviot, creator of the brand and holder of the intellectual property rights associated with the Tunetoo brand and related digital assets (domain names, site architecture, source codes, mock‑ups, customer database, etc.). As licensee, BDL is authorised to use these elements within the limits set by this agreement. The client acknowledges that operation of the website www.tunetoo.com is carried out under this licence.

1. Commercial Purpose

  • Tunetoo offers personalised products (clothing, items) sold via its website, www.tunetoo.com, to both private and professional customers.

2. Order

  • Placing an order implies unreserved acceptance of these GTC. The order becomes firm and final upon receipt of payment. A confirmation email is automatically sent to the client after the order. Tunetoo reserves the right to refuse or cancel any order for legitimate reasons, notably in case of existing dispute, non‑payment, or fraudulent use of the service.

3. Right of withdrawal and product return

  • In accordance with Article L.221‑28 of the French Consumer Code, the right of withdrawal does not apply to customised products. However, Tunetoo may review return requests on a commercial basis, without creating an obligation.

4. Product description and marking

  • Product characteristics (material, colour, cut) as well as customisation visuals are presented as faithfully as possible. Slight differences in shade or placement may appear between the on‑screen display and the final product. Such discrepancies cannot give rise to claims.

5. Designs

  • The client warrants that they hold the rights of use or reproduction for the files, texts or images uploaded. Tunetoo declines all responsibility in case of infringement of third‑party rights (copyright, trademark, image rights, etc.).

6. Product availability

  • If a product is unavailable after ordering, Tunetoo will offer an additional delay, an equivalent product, or a refund, subject to the client's prior agreement.

7. Prices

  • Prices are quoted in euros, all taxes included (VAT), excluding delivery charges. Customs duties or import taxes may apply to deliveries outside the European Union and are payable by the client.

8. Customisation proof

  • Depending on the level of customisation, Tunetoo may require additional validation from the client via a proof (BAT – "Bon à Tirer"). Validation of the proof constitutes final approval. No modification can be made after this step.

9. Client information

  • The client is solely responsible for the accuracy of the data they provide (contact details, shipping address, visuals, etc.). Tunetoo cannot be held liable for errors or delivery delays due to incorrect information.

10. Payment

  • Payment is made online via a secure interface provided by our banking partner Crédit Mutuel Arkéa (SSL protocol). Accepted payment methods are specified on the payment page.

11. Delivery

  • Delivery times are indicative and vary according to destination and order type. Tunetoo cannot be held liable for delays attributable to the carrier. In the event of abnormal delay, the client may put Tunetoo on notice to deliver within a reasonable period, in accordance with Article L.216‑1 of the French Consumer Code.

12. Return policy

13. Invoicing

  • Invoices are automatically issued by Tunetoo and available in the client area. Tunetoo accepts no liability for typographical or data entry errors on invoices.

14. Jurisdiction

  • Any dispute relating to the interpretation or execution of these GTC falls within the jurisdiction of the competent courts of Bordeaux, unless mandatory provisions more favourable to the consumer apply under French or European law.

Any reproduction or use of the site or any of its technical, textual or visual components outside this license framework is strictly prohibited.

16. Data protection

  • In accordance with the General Data Protection Regulation (GDPR), clients have the right to access, rectify, oppose and delete their personal data. 17. Governing law

  • These GTC are governed by French law.

18. Retention of title

  • Products remain the exclusive property of Tunetoo until full payment of the price by the client. In the event of non‑payment, Tunetoo reserves the right to repossess said products at the client's expense and risk.

19. Force majeure

  • Tunetoo shall not be liable for any delay or failure resulting from a force majeure event as defined by French case law: strike, fire, bad weather, interruption of transport, war, pandemic, power or telecommunications outage, or any other circumstance beyond its control.

20. Limitation of liability

  • Tunetoo shall not be liable for indirect damages, loss of business, loss of profit, loss of opportunity or intangible loss arising from the sale of a product. In any event, Tunetoo's liability is limited to the amount of the disputed order.

21. Website Use – TCU
